Description: Clean, age appropriate

Noncompliance Area: During the inspection on 3/2/26, the cots used for toddlers to sleep were not labeled for individual use as required by DHS-OCDEL regulation.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Description: Diapering materials storage

Noncompliance Area: While observing a diaper change at the time of inspection, the staff person did not change their gloves between the soiled and clean diaper. The same pair of gloves were used while changing the old diaper and placing the clean diaper. Increasing the chance of cross contamination.

Correction Required: Cloth and paper materials used as diapering aids shall be stored in a manner that prevents cross-contamination from a soiled diaper, contaminated hands or other changing materials.

Description: Emergency info/agreement updated 6 mos/Emergency master file updated

Noncompliance Area: While checking the children's files at the time of inspection, the classroom form and information in the child's file did not have matching dates.

Correction Required: A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information. If emergency information is updated in a master file, it shall be updated accordingly in other facility records.

Description: Toxic plants not permitted

Noncompliance Area: Upon arrival at the time of inspection, and, during the facility walk through. There were plants (entrance) and flowers in the children's bathroom. The flowers and plants were all accessible to the children

Correction Required: Toxic plants are not permitted in a child care space.

Regulation: 3270.151(a)/3270.151(c)(1)

Description: 12 months prior to service and every 24 months thereafter/Physical examination

Noncompliance Area: Per DHS-OCDEL regulations, staff #1 was observed serving food to fifteen mixed-age school-aged children. The staff health assessment form did not indicate the physician conducted a physical exam.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. An adult health assessment must include a physical examination.

Regulation: 3270.27(c)/3270.31(e)(4)(ii)

Description: Training regarding plan/Fire safety - 1 yr.

Noncompliance Area: The file for staff #1 did not have written proof of emergency plan and fire safety training on file at the time of inspection on 12/2/25.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility. Staff persons shall participate, at least annually, in fire safety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Description: Age and Training/Health and Safety Training - Pediatric First Aid and CPR

Noncompliance Area: At the time of inspection on December 2, 2025, the first-aid information in the file for staff #1 expired in 6/2024

Correction Required: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification. Staff persons shall complete professional development in the topic of pediatric first aid and pediatric cardiopulmonary resuscitation within 90 days of hire.

Description: Health and Safety Training

Noncompliance Area: At the time of inspection on 12/2/25, the file for staff #1 did not have written proof of comply with the Health and Safety requirements on file within 90-days of hire as required by OCDEL regulations.

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10.

Description: Each staff person meets quals/Individual Records

Noncompliance Area: Upon request, at the time of inspection, there was no file on-site for staff #1. The staffer was observed serving food and caring for fifteen mixed-age school-ag children.

Correction Required: A staff person or a substitute staff person shall meet one of the applicable staff qualifications for the position in which the person is performing. An individual record is required for each facility person.

Regulation: 3270.35(d)

Description: Director only 45 children enrolled

Noncompliance Area: At the time of inspection, there were fifteen children with one staff disembarking a school bus. When asked by CR who/where the second staffer was; staff #2 indicated they were the second staff person. CR informed the staff #2, based on enrollment, they could not also be counted as classroom staff.

Correction Required: A director may not function as a group supervisor in a facility in which more than 45 children are enrolled.

Regulation: 3270.52/3270.54(b)

Description: Mixed Age Level/Two facility persons on excursions

Noncompliance Area: At the time of inspection, on the afternoon of 12/2/2025, Fifteen mixed-age school children were observed entering the facility with one staff person. The youngest child was attending kindergarten.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff: child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level).

Regulation: 3270.101(a)/3270.101(c)

Description: Age appropriate/Include 6 categories of development

Noncompliance Area: During the inspection on 7/28/25, there were only three of fourteen classrooms with adequate supplies for enrolled children as required by the regulations.

Correction Required: Play equipment and materials appropriate to the developmental needs, individual interests and ages of the children shall be provided in sufficient amount and variety to preclude long waits for use. Play equipment and materials shall include the items specified at §3270.101(c)(1) - (6).

Regulation: 3270.103

Description: Small Toys and Objects

Noncompliance Area: During the inspection, in a classroom identified as a Toddler room, there were toys smaller than 1 inch that fell through a toilet paper roll which could be a choking hazard to the children in care.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.
