Regulation: 3270.113(a)

Description: Supervised at all times

Noncompliance Area: At the time of inspection. 11 facility children were observed unsupervised in their classroom.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. TIERED LIS: Children must be supervised at all times.

Regulation: 3270.124(b)(6)/3270.124(b)(7)

Description: Insurance coverage information/Name/address/phone release person

Noncompliance Area: At time of inspection, the parents of child #1 did not have the health insurance policy number documented on their child's emergency contact form. The parents of child #2 did not have the address of release person documented on their child's emergency contact form.

Correction Required: Emergency contact information must include health insurance coverage and policy number for a child under a family policy or Medical Assistance benefits, if applicable. Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

Regulation: 3270.131(d)(8)/3270.131(e)(2)(i)

Description: Age appropriate screenings complete/Exemption documentation from parent/guardian

Noncompliance Area: At time of inspection, child # 3 did not have immunization record with updated influenza immunization or signed exemption form documented as required per regulations.

Correction Required: A health report shall include a statement that age-appropriate screenings recommended by the American Academy of Pediatrics were conducted since the time of the previous health report required by this section. Exemption from immunization for religious belief or strong personal objection equated to a religious belief shall be documented by a written, signed and dated statement from the child's parent or guardian. The statement shall be kept in the child's record.

Regulation: 3270.15(b)/3270.61

Description: Building Codes/Measurement and use of indoor child care space

Noncompliance Area: At time of inspection, it was observed that a permanent wall had been instructed to separate the multi-purpose room to provide space for another childcare space to be used for childcare in facility. There was not an updated CO or letter provided to prove that the wall that was constructed is safe and in compliance with L & I requirements. In addition, the space was not measured by OCDEL to determine number of children that can occupy the space.

Correction Required: The legal entity shall maintain ongoing compliance with the applicable requirements prescribed by the Department of Labor and Industry in 34 Pa. Code § 403.23 and under section 1016(c) of the act at all times following issuance of any certificate of compliance issued by the Department under this chapter. Regulation: 3270.32(a)/3270.192(2)(iii)

Description: Comply with CPSL/Exp, educ., training at facility

Noncompliance Area: Staff person #1, hired within the last 3 months did not have required mandated reporter training documented in their record.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). SAFETY PLAN: The operator is required to submit to the Children and Youth Agency a plan of supervision or alternate arrangement as required by the Child Protective Services Law. LACKING REQUIRED HIRING DOCUMENTS: Facility Person #1-- may not work in a childcare position at the facility. PROVISIONAL HIRE UNSUPERVISED: A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee. A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Description: No peeling paint or plaster

Noncompliance Area: At time of inspection, chipped paint was observed on the door on room # 2, room #3 and on the bathroom, door located in room #6.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Regulation: 3270.76

Description: Building Surfaces

Noncompliance Area: During time of inspection, the cubbies location in the hallway area of facility were not mounted to prevent they from accidently falling over and becoming a hazard to children in space.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Regulation: 3270.82(h)

Description: Handwashing signs

Noncompliance Area: During time of inspection, the hand washing requirement was not posted in any of the bathroom and/or sink areas of the facility as required.

Correction Required: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility.
