Correction Required: An agreement shall specify the services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information at § 3280.124(f).

Noncompliance Area: During renewal inspection on Wednesday, 08/26/26, cert rep observed missing emergency contact information for children receiving care.

Correction Required: When children are in the facility, emergency contact information shall be present in a child care space for children receiving care in the space.

Description: No peeling paint or plaster

Noncompliance Area: During renewal inspection on Wednesday, 08/26/26, cert rep observed chipped paint in the bathroom located in the basement child care space.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Noncompliance Area: In review of children files, child 3 emergency contact and file failed to have signed parental consent for emergency medical care.

Correction Required: Emergency contact information must include the written consent signed by a parent for emergency medical care. A child's record must contain signed parental consent for emergency medical care for the child. Written consent is required prior to admission.

Description: Updated every 6 months/Emergency info/agreement updated 6 mos

Noncompliance Area: In review of children's files, child 1 emergency contact and fee agreement failed to be updated within a 6-month period. Child 2 emergency contact failed to be updated within a 6-month period.

Correction Required: The parent shall update in writing emergency contact information once in a 6-month period or as soon as there is a change in the information. A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Description: Infant: updated health report every 6 months/Initial and subsequent health assessments

Noncompliance Area: In review of children's file, child 1, a young toddler, file failed to have an updated health report. Health report contained in child's 1 file was last completed on 04/05/24.

Correction Required: The operator shall require the parent to provide an updated health report at least every 6 months for an infant or young toddler. A child's record must contain initial and subsequent health reports.

Description: Pertinent Laws & Regulations/General Health and Safety

Noncompliance Area: Staff person 1 was observed to be caring for children unsupervised. Staff person 1 does not have current pediatric first-aid/CPR training. This is evidenced by the previously documented pediatric first- aid/CPR training expiration date of 08/18/25.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required pre- service trainings are completed, staff person 1 must be supervised, when interacting with children at a minimum by, a primary staff person, who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person 1, staff person 1 may not work in a child-care position at the facility.

Regulation: 3280.182(5)

Description: Consent for administration of minor first-aid required prior to admission

Noncompliance Area: In review of children files, child 3 file failed to have signed parental consent for administration of minor first-aid procedures.

Correction Required: A child's record must contain signed parental consent for administration of minor first-aid procedures by facility staff. Written consent is required prior to admission.

Regulation: 3280.31(e)(4)(i)

Description: Age and training

Noncompliance Area: Staff person 1 has not completed Pediatric first aid and CPR training on or before expiration of the most current certification. This is evidenced by the previously documented Pediatric first aid and CPR training on file expiring 08/18/23. Documentation of updated Pediatric first aid and CPR training is not on file.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and CPR. All staff persons shall renew their certification in pediatric first-aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification. Until such time as the required training has been completed, staff person 1 must be supervised, when interacting with children at a minimum by, a primary staff person, who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person 1, staff person 1 may not work in a child-care position at the facility.

Regulation: 3280.31(e)/3280.192(2)(iii)

Description: Age and training/Exp, educ., training at facility

Noncompliance Area: In review of staff files, staff person 1 failed to have completed 12 hours of annual professional development training. Staff person 1 file only contained 5 hours of annual training.

Correction Required: A staff person shall obtain an annual 12 clock hours of child care training. A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Regulation: 3280.53(b)/3280.61(h)

Description: Counted for capacity /Measurement and use of indoor child care space

Noncompliance Area: During an allocated unannounced inspection on Tuesday, 04/15/25, cert rep observed facility over their measured capacity of 9. At the time of the inspection cert rep observed 16 children receiving care, 7 of the children in care was related children.

Correction Required: The related or foster children of an operator and the children or foster children of a staff person shall be counted in the capacity for the space. The capacity established for an indoor space may not be exceeded.

Regulation: 3280.94(a)(1)

Description: Every 60 days

Noncompliance Area: During allocated unannounced inspection on Tuesday, 04/15/25, facility failed to have conducted a fire drill at least once every 60 days. The last documented fire drill was conducted on 08/29/24.

Correction Required: The primary staff person or designated staff person who is responsible for compliance with this chapter shall conduct fire drills and ensure that fire drills are conducted at least once every 60 days.

Regulation: 3280.95(a)/3280.95(b)

Description: FIRE DETECTION/Staff responsibility

Noncompliance Area: During allocated unannounced inspection on Tuesday, 04/15/25, fire safety documents reviewed, facility failed to have tested their smoke detection system once every 30 days and document testing or have verification the smoke detection system was inspected by a fire safety professional.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)). The primary staff person or designated staff person who is responsible for compliance with this chapter shall ensure the requirements in subsection (a) are met.

Regulation: 3280.26(a)(6)

Description: Emergency plan

Noncompliance Area: In review of emergency plan documents, facility failed to have conducted an annual drill on the emergency plan procedures. The last drill was conducted on 07/07/23.

Correction Required: Emergency drills shall be conducted annually. Annual emergency drills shall be documented and on file at the facility.
