Noncompliance Area: The rubber mulch under the embedded climbing structure in the PS S/A play space was measured at 4 inches. The requirement for rubber mulch is 6 inches.

Correction Required: Outdoor equipment that requires embedded mounting must be mounted over a loose-fill or unitary playground protective surface covering that meets the recommendations of the United States Consumer Product Safety Commission. The equipment must be anchored firmly and be in good repair.

Description: Immunization record/Dismissal policy

Noncompliance Area: The file for Child #3 lacked verification that the child had received their 15--18-month DTAP and 12--15-month Pneumococcal vaccinations as recommended by the ACIP. A written exemption was not on file at the time of the inspection.

Correction Required: A health report shall include a review of the child's immunized status according to recommendations of the ACIP. The facility shall implement dismissal policies in accordance with the Department of Health regulation in 28 Pa. Code § 27.77 (relating to immunization requirements for children in child care group settings). Child #3 will be dismissed from care at the close of business on 6.23.26,

Description: General Health and Safety

Noncompliance Area: Two packing tape dispensers with sharp edges for cutting were observed in an unlocked drawer in the Downstairs Brown classroom. The drawer was accessible to school age children receiving care in the child care space.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.

Description: Comply with CPSL

Noncompliance Area: The file for Staff Person's #1 lacked a current disclosure statement prior to starting at the facility. The disclosure statement on file was an older version and did not include all information required by the CPSL. A current disclosure was not on file until 88 days after starting in a child care position. The file for Staff Person #2 lacked a completed PA State Police Clearance and they have exceeded 45 days in a child care taking position at the facility. A completed PA State Police Clearance was not on file until 141 days after starting in a child care position.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).

Description: Building Surfaces

Noncompliance Area: The toilet in the restroom in Classroom #2 (the Blue Room) was observed to be missing a bolt cover allowing one of the bolts to be exposed. This posed a visible hazard.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Description: No peeling paint or plaster

Noncompliance Area: An area of peeling paint was observed on the wall to the left of the restroom door in Classroom 2 (the Blue Room).

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Noncompliance Area: The file for Staff Person #1 lacked verification that they had been fingerprinted for their FBI Clearance prior to starting at the facility. A completed FBI Clearance was dated 2 days after starting.

Noncompliance Area: It was observed in the infant room that a nonprescription bottle of gas drops for child #1 had the expiration date of 6/2023, which was not in accordance with the manufacturer's instructions.

Correction Required: Medication shall be stored in accordance with the manufacturer's or health professional's instructions on the original label.

Noncompliance Area: The fire detection system testing log for the main building contained dates of 10-17-22 to 11-17-22, the fire detection system testing log for brown building 1 and 2 contained dates of 1-24-23 to 2-24-23, and 3-24-23 to 4-24-23 which is more than 30 days.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.
