Findings: An unannounced site visit was conducted to investigate a complaint alleging that on December 5, 2024 , 9 children were observed in attendance. On December 5, 2024, L S attempted to conduct the site visit but did not gain entry. The Specialist called the provider and left a message. The provider called back and stated she was closed for the day. A follow up visit was conducted on December 9, 2024, to complete the complaint investigation. Upon arrival licensing specialist observed 8 children in care including the provider's son doing a sensory activity. Specialist observed 2 children under 2, 4-2 year old children and 2-3 year old children present. Specialist observed the sign in log and observed the children signed in for the day. Specialist discussed the complaint and was informed by the provider that on December 5, 2024, she was observed with a total of 9 children. An MSDE Representative observed the overcapacity. Per the Provider one parent had mixed up the dates that their child was supposed to come to the daycare and that is what the representative observed. The provider stated she was sick and closed early and the parents came and picked up the children early.

Findings: LS discussed supervision when children are in care and the use of a substitute. Per provider, the substitute allowed the child in care. The provider stated she didn't know because she was doing circle time. When the provider noticed the additional child, she stated she called the parent to pick up their child. Provider may not exceed approved capacity at any time . The capacity must be maintained. LS advised the provider that the child should not have been allowed in care. Per the Provider she called the parent to return and pick up child .

Findings: LS observed two (2) children under the age of two years old. Provider is approved for one (1) child under the age of two (2) years old.

Findings: LS observed one (1) child under 12 months asleep in a car carrier. Provider stated that the children had been sleeping for approximately 1 hour, but that the child in the carrier had been asleep for less than one hour. LS advised Provider to place the child into an appropriate sleep space. Corrected on site.
