Conditions at the facility may not pose a threat to the health or safety of the children.

Noncompliance Area: Facility person #2, who qualifies only as a volunteer, was observed accompanying one YSA and one OSA during a trip to the restroom which was not located in the childcare space. Because Staff #1 was not present, the children were not supervised by a staff person at all times.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Noncompliance Area: Staff #1 was observed alone during Renewal Inspection on December 9, 2024, with 18 school age children including both younger school age and older school age. Therefore, during the inspection ratio was 1:18. Also, Facility person #2, who qualifies only as a volunteer, was observed supervising one YSA and one OSA during a trip to the restroom. Because Facility Person #2 does not qualify as staff, the ratio was 0:2.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level).

Noncompliance Area: Based on Fire Drill documentation, there was a gap in the documentation exceeding 60 days where a fire drill was not conducted, 2/12/24 and 9/5/24. Based on conversation with the director, school was out for the summer at the end of May, although school was still operating during the time another fire drill should have occurred.

Correction Required: The Director or designated staff person who is responsible for compliance with this chapter shall conduct fire drills and ensure that fire drills are conducted at least once every 60 days.
