Noncompliance Area: During the inspection, posters were observed to be attached to the wall using flat push pins.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Description: Age and training

Noncompliance Area: Documentation showed Staff #1 completed CPR training on 6/1/23 and again on 10/9/25, exceeding the requirement that CPR training be completed on or before the expiration date.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and CPR. All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification.

Description: Comply with CPSL/CPSL information

Noncompliance Area: Documentation showed that staff #1 had a PA state police clearance dated 1/14/26 with a previous PA state police clearance dated 10/21/20, exceeding the requirement that clearance be renewed every 60 months. Documentation showed that staff #1 had a child abuse clearance dated 1/16/26 with a previous child abuse clearance dated 11/18/20, exceeding the requirement that clearance be renewed every 60 months.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1 may not work in a child care position at the facility.

Regulation: 3290.95(a)/3290.95(b)

Description: System in compliance/Operator or designated staff responsibility

Noncompliance Area: Documentation showed a fire system test conducted on 4/10/26 and again on 5/11/26, exceeding the requirement that fire system tests be conducted every 30 days.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The operator or designated staff person who is responsible for compliance with this chapter shall ensure the requirements in subsection (a) are met.

Regulation: 3290.105(f)

Description: 2 feet apart

Noncompliance Area: It was observed that there is not 2 feet of space on three sides of the pack and plays used for rest times.

Correction Required: At least 2 feet of space is required on three sides of a bed, cot, crib or other rest equipment while the equipment is in use.

Regulation: 3290.113(a)

Description: Supervised at all times

Noncompliance Area: It was observed that staff person #1 answered the door, for Cert. Rep. to enter, with two children, two more children were in the child care space unsupervised. It was observed that staff person #1 walked out of the room, to the kitchen multiple times, leaving three or four children unsupervised. It was observed that child #1 walked out of the room multiple times, without supervision.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. The requirement for supervision on and off the facility premises includes compliance with the staff:child ratio requirements in §§ 3290.51-3290.52 (relating to maximum number of children; and staff:child ratio).

Description: Parent receives original/Copy of initial and subsequent agreements. Parent receives original.

Noncompliance Area: Children #1, 2, 3, 4, 5 and 6's files contained the original agreements.

Correction Required: A parent shall receive the original agreement. The facility shall retain a copy of the agreement. A child's record must contain a copy of the initial agreement and subsequent written agreements between the parent and the operator. The parent receives the original agreement.

Regulation: 3290.131(b)(2)

Description: Updated toddler/preschool health report: every 12 months

Noncompliance Area: Child #6's file does not contain an updated health assessment within 12 months. The last child health report in file is dated 4/26/24.

Correction Required: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child.

Noncompliance Area: The emergency plan does not include information on a method for facility persons to contact parents when an emergency arises, ends or instructions for how to reunite parents with children.

Correction Required: The facility shall have an emergency plan that provides for a method for facility persons to contact parents as soon as reasonably possible when an emergency situation arises. The facility shall have an emergency plan that provides for a method for facility persons to inform parents that the emergency has ended and to provide instruction as to how parents can safely be reunited with their children.

Noncompliance Area: First-aid kit does not contain disposable, nonporous gloves.

Correction Required: A first-aid kit must contain the following: soap, an assortment of adhesive bandages, sterile gauze pads, tweezers, tape, scissors and disposable, nonporous gloves.

Description: Requirements

Noncompliance Area: It was observed that there were stacks of paper and clutter on the table, and on top of the printer. It was observed that there was debris on the carpets and floor.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play area, shall be kept clean, in good repair and free from visible hazards.

Regulation: 3290.75(a)

Description: No peeling paint or plaster

Noncompliance Area: It was observed that there is a hole in the chalkboard wall, with exposed drywall.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Description: Heat Source

Noncompliance Area: The hot water in the bathroom sink, used for handwashing, was measured at 120 degrees.

Correction Required: Hot water pipes and other sources of heat exceeding 110° F that are accessible to children shall be equipped with protective guards or shall be insulated to prevent direct contact.

Regulation: 3290.102(e)

Description: Infant/toddler - no material less than 1 inch

Noncompliance Area: It was observed in the outside play space that there was small rubber mulch in the space beside the porch accessible to children under 3 years of age.

Correction Required: Pea gravel and other materials with a diameter of less than 1 inch may not be used in spaces where infants or toddlers receive care.

Regulation: 3290.105(a)

Description: Clean, age appropriate

Noncompliance Area: It was observed that the pack n' play used by the one-year-old for napping was not labeled labeled with the child's name.

Correction Required: (a) Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the parent and the operator. The rest equipment must be labeled with the child's name and used only by the named child while enrolled in the program.
