Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility. A child's record shall contain initial and subsequent health reports.

Noncompliance Area: During the renewal inspection, certification representative reviewed 3 staff files and the file for staff #2 did not contain a health assessment or TB results.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Noncompliance Area: During the renewal inspection, certification representative reviewed 3 staff files and there was no staff file for staff #3.

Correction Required: An individual record is required for each facility person.

Description: Emergency plan/Emergency plan

Noncompliance Area: During the renewal inspection, certification representative reviewed the facility files and the emergency plan did not include specific information on how staff are to respond in the event of an evacuation or how they get to the relocation area at another facility.

Correction Required: The facility shall have an emergency plan that provides for accommodations for shelter of children during an emergency including lock-down, shelter in place at the facility and shelter at locations away from the facility premises. The facility shall have an emergency plan that provides for accommodations for evacuation of children from the facility building and evacuation of children to a location away from the facility premises. The evacuation routes and evacuation plans to exit the building may be the same as those required by §3270.94 (relating to fire drills).

Noncompliance Area: During the renewal inspection, certification representative reviewed 3 staff files and the file for staff #1 and staff #2 did not include fire safety trainings.

Correction Required: Staff persons shall participate, at least annually, in fire safety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Noncompliance Area: During the renewal inspection, certification representative reviewed 3 staff files and the file for staff #1 and staff #2 did not include a disclosure form.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). SAFETY PLAN: The operator is required to submit to the Children and Youth Agency a plan of supervision or alternate arrangement as required by the Child Protective Services Law. LACKING REQUIRED HIRING DOCUMENTS: Facility Person # -- may not work in a child care position at the facility. PROVISIONAL HIRE UNSUPERVISED: A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #--- may not work in a child care position at the facility.

Regulation: 3270.113(a)(1)

Description: Staff assigned to specific children

Noncompliance Area: During the renewal inspection, certification representative conducted a facility walk through and staff #4 was working alone and allowing children to walk down the hall alone to the bathroom. At some point a school district employee came to tell staff #4 to only allow two children in the bathroom at a time due to a plumbing issue with one of the stalls. Children had to walk past rm 214, which is the custodian room, that was open with various cleaning supplies accessible. Also, two children were released for the day and allowed to get on the elevator, unattended,without proper staff supervision. They both got on the elevator together to leave for the day.

Correction Required: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Noncompliance Area: During the renewal inspection, certification representative reviewed facility files and 1. there was no policy for shaken baby syndrome and child maltreatment per Announcement C-22-03 that was issued on January 24,2022. 2. The emergency plan contained the address for another location and was not specific to the building where the program is located(referenced floors that are not used), did not include continuity of operations or specific staff duties as required.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children.

Noncompliance Area: During the renewal inspection, certification representative reviewed the facility files and there was no certificate of occupancy on file at the facility.

Correction Required: The legal entity shall maintain ongoing compliance with the applicable requirements prescribed by the Department of Labor and Industry in 34 Pa. Code § 403.23 and under section 1016(c) of the act at all times following issuance of any certificate of compliance issued by the Department under this chapter.

Noncompliance Area: During the renewal inspection, certification representative reviewed 3 staff files and the file for staff #3 did not contain a health assessment or TB results.

Correction Required: An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Noncompliance Area: During the renewal inspection, certification representative reviewed 7 staff files and the file for staff #2 did not include a verification of childcare experience.

Correction Required: A facility person's record shall include verification of child care experience, education and training prior to service at the facility. A facility person's record shall include acceptable verification of experience, education or training is a transcript or a diploma or a letter signed by a representative of the experiential, educational or training entity.
