Corrective Action: Ensure staff are following all applicable state laws and regulations (face covering and social distancing requirements per the governor’s COVID-19 State of Emergency). LS Kenton observed several staff not wearing face coverings. This was corrected at the visit when staff members put on face coverings.

Corrective Action: Ensure written permission is received from the parent/guardian prior to disclosing or using a child’s written, electronic, or digital information. Staff #1 sent a picture of Child #1 through text message to the Reporter and Parent #1. The Reporter had only given permission for pictures to be sent through the HiMama Program to her email. Notify staff in writing about all requirements regarding disclosing a child’s written, electronic, or digital information. Have staff sign the notification acknowledging they have received the information and submit verification of completion to OCCL by 03/31/2020.

Corrective Action: Ensure only qualified staff members are alone with the children. LS Kenton observed Staff #2, an aide, alone with a napping group of four to five-year-olds. Staff #3, an aide, was observed alone with a group of napping toddlers while Staff #1 left the classroom to get children off the bus. This was corrected when Ms. Hoffman entered the classroom with Staff #2 and Staff #1 entered the classroom with Staff #3. Maintain staff-to-child ratios at all times.

Corrective Action: Ensure the facility is following policies set forth in the parent handbook. This was corrected when the administrator was contacted and agreed to comply in the future.

Corrective Action: Ensure the administrator is present at the center the required amount of time and functioning in that role. Administrator Hoffman was not present during the facility visit and did not have record of her schedule or timesheet for review. Send two weeks’ worth of the administrator’s attendance to OCCL by November 22, 2019.

Corrective Action: Available video footage for October 24, 2019, showed Staff #1 improperly discipline two children by grabbing one child under the arms and tossing him on the floor after he was arguing over who could sit in a chair with another child and this staff member also was observed flicking another child on the arm and on the head and grabbing him. Ensure staff use positive developmentally appropriate methods of behavior management when disciplining a child. This was corrected when the staff member was immediately terminated.

Corrective Action: Video footage revealed one staff was alone in the classroom with 7-8 children, the youngest child was one-year-old, while another staff left the room to conduct diaper changes. Maintain correct ratios at all times. The administrator agreed to have a floater go into the classroom to cover diaper changes when a staff leaves the classroom or she will have the floater take children to the bathroom to ensure correct ratios are maintained.

Corrective Action: A staff member squirted a child in the face with water who was not listening. Before this investigation occurred, the staff member received a disciplinary notice from the center’s administrator for this action. Ensure staff members only use the center’s positive behavior management techniques. The staff is no longer employed at the center.
