Noncompliance Area: During renewal inspection on Tuesday, 06/09/26, staff person 1 was observed to be caring for children unsupervised. Staff person 1 has not completed the following pre- service training required prior to caring for children unsupervised: pediatric first-aid and pediatric CPR.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required pre- service trainings are completed, staff person 1 must be supervised, when interacting with children at a minimum by, an AGS, who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person 1, staff person 1 may not work in a child-care position at the facility.

Description: Transcript, diploma and letters

Noncompliance Area: In review of staff files, staff person 3 failed to have education received abroad failed to be translated and evaluated to determine the US equivalent.

Correction Required: A facility person's record shall include acceptable verification of experience, education or training is a transcript or a diploma or a letter signed by a representative of the experiential, educational or training entity.

Description: Two written references

Noncompliance Area: In review of staff files, staff person 3's file failed to include two written non-related references.

Correction Required: A facility person's record shall include two written, nonfamily references from individuals attesting to the person's suitability to serve as a facility person.

Regulation: 3270.27(a)(6)

Description: Emergency plan

Noncompliance Area: In review of emergency plan documents, facility failed to have conducted an annual drill on the facility's emergency plan procedures. The last documented drill was conducted on 06/24/24.

Correction Required: Emergency drills shall be conducted annually. Annual emergency drills shall be documented and on file at the facility.

Regulation: 3270.31(e)(4)(ii)/3270.192(2)(iii)

Description: Fire safety - 1 yr./Exp, educ., training at facility

Noncompliance Area: in review of staff files, staff failed to have completed annual fire safety training. Staff last completed training on 05/15/25.

Correction Required: Staff persons shall participate, at least annually, in fire safety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent. A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Noncompliance Area: In review of staff files, staff person 2 file failed to include 12 annual hours of PD training. File only contained 11 hours of PD training.

Correction Required: A staff person shall obtain an annual minimum of 12 clock hours of child care training. A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Description: Comply with CPSL/CPSL information

Noncompliance Area: In review of staff files, staff person 3's file failed to include out of state child abuse and sex offender registry check. Staff person 4's file failed to include NSOR certificate.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: Facility Person 3 may not work in a child care position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person 4 may not work in a child care position at the facility.

Description: Building Surfaces

Noncompliance Area: During renewal inspection on Tuesday, 06/09/26, cert rep observed trash and other items in the outdoor play space that may cause possible hazardous.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Regulation: 3270.77(a)

Description: No peeling paint or plaster

Noncompliance Area: During renewal inspection on Tuesday, 06/23/26, cert rep observed chip paint located on the half wall in the school age area.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Description: Training regarding plan/Exp, educ., training at facility

Noncompliance Area: At the time of inspection on 8/25/25, the file for staff #2 did not have written proof of annual emergency plan training. The document on file was dated for 7/ /24.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility. A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Noncompliance Area: During the inspection on 8/25/25, the most recent CPSL requirement (FBI) in the file for staff #1-hire date May, 2000 was dated for 6/10/20. The IdentoGO receipt on file was dated for 8/25/25.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). SAFETY PLAN: The operator is required to submit to the Children and Youth Agency a plan of supervision or alternate arrangement as required by the Child Protective Services Law. LACKING REQUIRED HIRING DOCUMENTS: Facility Person #1 may not work in a child care position at the facility. PROVISIONAL HIRE UNSUPERVISED: A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Description: Mixed Age Level

Noncompliance Area: While on the outdoor PlaySpace on the morning of 8/25/25, eight mixed-age children were observed in the care of one staff (Staff #3). The age of the youngest child was 2-yrs-old.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level).

Description: Mixed Age Level

Noncompliance Area: During the facility visit 9/20/24 , Eight mixed-aged children, (the youngest were three children each two-years-old) all observed on the rear outdoor play area in the care of staff #1. Staff #2 was caring for two infants inside the facility. Staff #3 was in the facility office area and gave admittance to the OCDEL/CR. When the CR and staff #3 entered the first classroom area, where staff #4 was standing, staff #3 asked staff #4, "did you want to help her? She is here to do the follow-up" referring to CR. Continue non-compliance from 08/05/24 renewal visit.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level).

Regulation: 3270.104(a)

Description: Clean, good repair, proper size

Noncompliance Area: At the time of inspection on 8/5/24, there were two large cabinets with gallon size bottles on top which were not mounted. If tipped/toppled the cabinets or items on top could case a hazard to the children in care.

Correction Required: Furniture must be durable, safe, easily cleaned and appropriate for the child's size, age and special needs.
