Correction Required: A written plan identifying the means of transporting a child to emergency care and staffing provisions in the event of an emergency shall be displayed conspicuously in every child care space and shall accompany a staff person who leaves on an excursion with children.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Noncompliance Area: Files for Staff # 1 and # 2 were not in compliance with CPSL regulations. NSOR clearance for Staff # 1 was past 60 months, dates were 12/13/19 and 6/5/25. File for Staff # 2 did not contain an FBI clearance, staff was fingerprinted on 12/28/24.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person # 2 may not work in a childcare position at the facility. Tiered LIS: 1. Staff # 1 will not work in childcare until a complete FBI clearance is on file. This portion of the plan shall have an immediate correction date. 2. Director will write a policy on how CPSL regulations will be tracked. This policy must be approved by DHS. This portion of the plan shall have a correction date of when this will be completed.

Noncompliance Area: Facility self-reported that Child # 1 was left on the playground for 90 seconds. Staff # 1 was immediately terminated and staff # 2 and # 3 were retrained in name to face supervision. Child was found by another staff person.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises. Staff # 2 and # 3 will review facility's supervision policy and sign that this has been completed.

Staff person #1 started at the facility on 1/7/23 and did not complete health & safety training until 8/12/23. Staff person #2 started at the facility on 1/3/23 and did not complete health & safety training until 7/7/23. Staff person #5 started at the facility on 11/28/22 and did not complete health & safety training until 6/17/23.

Noncompliance Area: Staff person #4 started at the facility on 12/27/22; her NSOR is dated 3/16/23. Staff person #3 started at the facility started at the facility on 4/17/23; her NSOR is dated 8/1/23. There is verification that both staff person #3 & staff person #4 applied for the NSOR clearance prior to starting at the facility, but neither submitted the NSOR clearance within 45 days as required by Act 12.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. The CPSL was revised on 9/18/2018 to include a requirement that all clearances be updated and on file at least every 60 months. The Child Protective Services Law (CPSL) was revised to include the requirement for the National Sex Offender Registry (NSOR) Clearance effective 9/30/2019. The CPSL also states that anyone hired after 9/30/19 was required to have the NSOR clearance to work in childcare. Current staff must have the NSOR clearance no later 7/1/20. CPSL was revised to include new hires that have resided out of Pennsylvania with in the 5 previous years must obtain State Police and Child abuse clearances from the state that they have resided.

Noncompliance Area: During a complaint investigation that was conducted on 8/16/22, it was determined that on 8/15/22, two toddlers were left on the outside play space by Staff Person #1, Staff Person #2 & Staff Person #3. The two children were left unsupervised on the outdoor play space for between 1-2 minutes before they were discovered by another staff member.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Children must be supervised at all times. The legal entity must arrange for all facility staff to receive a minimum of four hours of in-person training regarding supervision of children. The legal entity must receive DHS approval of the training content prior to scheduling the training.
