Description: Inaccessible to children/Child Medication and Special Diets

Noncompliance Area: A first aid kit containing medications was on a chair and accessible to children.

Correction Required: A first-aid kit must be inaccessible to children. The operator shall make reasonable accommodation in accordance with applicable federal and state laws to facilitate administration of medication or a special diet that is prescribed by a physician, physician's assistant or CRNP as treatment related to the child's special needs. Facility persons are not required to administer medication or special diets which are requested or required by a parent, a physician, a physician's assistant or a CRNP but are not treatment related to the child's special needs.

Description: Clean and good repair

Noncompliance Area: The playground playhouse entrance floor was cracked.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Description: Exemption documentation from parent/guardian

Noncompliance Area: Child health forms on file for children #1 and #2 do not include the influenza vaccine for the 2022-23 flu season. (Letters of exemption were obtained from parents on the day of inspection.)

Correction Required: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Description: General Health and Safety/Building Surfaces

Noncompliance Area: It was observed in the bathroom of the front classroom, a bucket full of unknown liquid substance and containing mold in the cabinet under the sink. (corrected on site)

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children. Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Description: Locked or inaccessible

Noncompliance Area: It was observed in the bathroom of the back classroom, a can of Lysol was kept in an unlocked cabinet and accessible to children. (corrected on site)

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.

Description: No insects or rodents

Noncompliance Area: It was observed in the bathroom of the front classroom, rodent feces on the floor and inside the cabinet under the sink. (corrected on site)

Correction Required: Evidence of infestation of insects or rodents in the facility is not permitted.

Regulation: 3270.95(a)/3270.95(b)

Description: Devices must be compliant/Director or designated staff person ensure compliance

Noncompliance Area: Operability of the fire detection devices were not tested every 30 days. Testing was documented to have lapsed 10/6/22-11/22/22.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Description: Age and Training/Exp, educ., training at facility

Noncompliance Area: The file for staff #1 who was hired prior to 12-19-2020 contained 10.5 hours of training by the mandatory training date of 12-19-2021. The file for staff #2 who was hired prior to 12-19-2020 contained 6 hours of training by the mandatory training date of 12-19-2021.

Correction Required: A staff person shall obtain an annual minimum of 12 clock hours of child care training.A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Regulation: 3270.65

Description: Protective Outlet Covers 5 yrs. or less

Noncompliance Area: In the Young Toddler Room, one electrical outlet did not have an outlet cover and was accessible to children under the age of five.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Noncompliance Area: The file for staff #1 lacked a staff evaluation within 12 months. The last staff evaluation on file was dated 4-3-2018.

Correction Required: A director is responsible for written evaluation of staff persons on a regular basis, a minimum of one evaluation every 12 months.

Noncompliance Area: The file for staff #1, with hire date of 02-22-2018, lacked the correct official State Police Clearance required under the CPSL.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Facility Person 1# -- may not work in a child care position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: A copy of the applicable regulations under which the facility is certified was not posted in a conspicuous location used by parents.

Correction Required: The facility's current certificate of compliance and a copy of the applicable regulations under which the facility is certified shall be posted in a conspicuous location used by parents, with instructions for contacting the appropriate regional day care office posted at the same location.
