Correction Required: Emergency contact information must include the written consent signed by a parent for emergency medical care. A child's record must contain signed parental consent for emergency medical care for the child. Written consent is required prior to admission.

Description: Child's hands washed

Noncompliance Area: While observing Staff person #2 changing an infant's diaper, Staff person #2 had to be prompted to wash the infant's hands at the conclusion.

Correction Required: A staff person shall ensure that a child's hands are washed before meals and snacks, after toileting and after being diapered.

Description: Maximum Number of Children

Noncompliance Area: Staff persons #1, #2 and #3 were observed caring for 12 unrelated children and 1 related child.

Correction Required: The number of children in care may not exceed six children at any one time who are unrelated to either the legal entity or the staff person. At any one time, the related children of either the legal entity or the staff person, but not both, may be excluded in determining compliance with this section.

Regulation: 3290.95(a)/3290.95(b)

Description: System in compliance/Operator or designated staff responsibility

Noncompliance Area: The facility's fire drill log was observed to document that manual testing of all fire detection devices or systems was not conducted at least once every 30 days. This was evidenced by testing dates of 1/24/26, and 02/17/26, 3/17/26 and 4/20/26 a period of 34 days.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The operator or designated staff person who is responsible for compliance with this chapter shall ensure the requirements in subsection (a) are met.

Description: 2 feet apart

Noncompliance Area: Observed a toddler sleeping in a pack n play which did not have 2 feet of space on three sides.

Correction Required: At least 2 feet of space is required on three sides of a bed, cot, crib or other rest equipment while the equipment is in use.

Description: Within 3 months, then 12 months/Mantoux TB

Noncompliance Area: Observed staff file #1 and facility person #2 did not contain a valid health assessment with the results of a TB screening test.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment on file at the facility. An adult health assessment shall include Tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, CRNP, the Department of Health or a local health department.

Description: Comply with CPSL

Noncompliance Area: Observed staff file #1, who has already started in a childcare position, did not contain a signed disclosure statement, a DHS FBI fingerprint clearance, and did not contain a CPSL required NSOR verification letter. Observed facility person #2 file did not contain a criminal background clearance, a child abuse clearance, or a DHS FBI fingerprint clearance.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Facility Person # -1 and 2- may not work in a childcare position at the facility.

Regulation: 3290.64(a)

Description: Locked or inaccessible - in original container

Noncompliance Area: Observed diaper cream accessible to children on a low shelf in the childcare space.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be kept in a locked area or in an area inaccessible to children, and shall be stored away from food, food preparation areas and child care spaces.
