Noncompliance Area: An allocated inspection was conducted on 7/24/26. At that time, the fire drill log was reviewed. The fire drills were not conducted every 60 days. The fire drills documented on the log were conducted 5/5/26 and 7/13/26, 69 days between the fire drills.

Correction Required: The Director or designated staff person who is responsible for compliance with this chapter ensure fire drills are conducted at least once every 60 days.

Description: Pertinent Laws & Regulations/General Health and Safety

Noncompliance Area: A renewal inspection was conducted 3/2/26. At that time, disinfectant spray, labeled "keep out of reach of children" was observed on a cart in the cafeteria where the children were receiving care. The disinfectant spray was accessible to the children.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. The OCDEL ANNOUNCEMENT C-24-02 School-Age Child Care Center Programs in a School Building must keep cleaning and other toxic materials in an area or container that is locked or made inaccessible to children.

Description: Health information/Initial health report for school age; accordance with school attendance

Noncompliance Area: A renewal inspection was conducted on 3/3/25 and 3/10/25. On 3/10/25, the child files were reviewed on site. The file for Child #2, who has been enrolled at the facility more than 60 days, did not include a health report.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility. The initial health report for a school-age child must be dated in accordance with the requirements for medical examinations for school attendance in 28 Pa. Code § 23.2 (relating to medical examinations).

Noncompliance Area: A renewal inspection was conducted on 3/3/25 and 3/10/25. On 3/10/25, an expired epi-pen (9/24) and expired albuterol (5/24) were observed at the facility for Child #1.

Correction Required: Medication shall be stored in accordance with the manufacturer's or health professional's instructions on the original label.

Description: Two written references

Noncompliance Area: A renewal inspection was conducted on 3/3/25 and 3/10/25. On 3/10/25, the staff file was reviewed for Staff Person #2. At that time, their file did not include two letters of reference.

Correction Required: A facility person's record shall include two written, nonfamily references from individuals attesting to the person's suitability to serve as a facility person.

Description: Training regarding plan

Noncompliance Area: A renewal inspection was conducted on 3/3/25 and 3/10/25. On 3/10/25, the staff file for Staff Person #2 was reviewed. Staff Person #2 did not have emergency plan training on file for the Governor Wolf Elementary Child Care Center.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility.

Description: Comply with CPSL/CPSL information

Noncompliance Area: A renewal inspection was conducted on 3/3/25 and 3/10/25. On 3/3/25, the staff files were reviewed. The NSOR on file for Staff Person #1 was not updated within 60 months. This is evidenced by the dates of the NSOR certificates: 1/16/2020 and 1/28/25.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Regulation: 3270.31(f)

Description: Health and Safety Training

Noncompliance Area: Facility staff # 1 & # 2 did not complete the required one-hour health and safety training by 12/30/22. Facility staff # 1 completed the training on 2/7/23 and facility staff # 2 completed the training on 2/9/23.

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10.
