Regulation: 3270.24(a)

Description: Immediate access

Noncompliance Area: During the unannounced monitoring cert rep and cert rep supervisor visited the facility on 6/28/2023 at 10:30 am. Cert rep and Cert rep supervisor were told by staff #1 that we had to wait on the porch until the director came back to the facility to do our inspection. Cert rep observed 2 staff on the first floor with 9 children ranging in age from older toddler to preschool. Cert rep supervisor went to the upstairs classrooms. Cert rep supervisor observed the door to the second floor was closed and she heard them lock the door. Cert rep supervisor knocked on the door and identified herself and was told thru the door that they would not open the door and was told by their director to tell us that we had to wait on the porch until the director gets there to do our inspection. Cert rep supervisor reiterated and asked are you denying me access. Cert rep supervisor was told the same thing again and they never opened the door. Cert rep could hear children playing, running and talking on the 2nd floor and was not able to gain access. Cert rep and cert rep supervisor left the facility at 11:17 am.

Correction Required: A staff person shall provide to agents of the Department immediate access to the facility, the children and the files and records.

Description: High Chairs

Noncompliance Area: During the renewal inspection cert rep observed an infant being fed in a car seat.

Correction Required: High chairs shall have a wide base and a T-shaped safety strap.

Regulation: 3270.106(a)

Description: Clean, age appropriate

Noncompliance Area: During the renewal inspection cert rep observed a child sleep with head down on the picnic table. The child was then laid down on a cot which was not labeled for that child.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Description: Supervised at all times

Noncompliance Area: During the renewal inspection cert rep observed a school age child unsupervised coming from the bathroom.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. TIERED LIS: Children must be supervised at all times. The legal entity must arrange for all facility staff to receive a minimum of two hours of training regarding supervision of children. The legal entity must receive DHS approval of the training content prior to scheduling the training. The legal entity must submit documentation in a format approved by DHS proving that the facility procedure for counting children is followed at all times e.g., a checklist. The legal entity will confirm continuing compliance by sending copies of the documentation to the Regional Office of Child Development and Early Learning on a weekly basis for a period of three months after DHS approves the documentation format.

Noncompliance Area: During the renewal inspection child #2 emergency contact did not include the parents work phone number on file.

Correction Required: Emergency contact information must include the home and work addresses and telephone numbers of the enrolling parent.

Regulation: 3270.131(a)(4)

Description: Initial health report for school age; accordance with school attendance

Noncompliance Area: During the renewal inspection child #1 and 3 did not have a health assessment on file.

Correction Required: The initial health report for a school-age child must be dated in accordance with the requirements for medical examinations for school attendance in 28 Pa. Code § 23.2 (relating to medical examinations).

Noncompliance Area: During the renewal inspection staff #2 and 3 did not have Health and Safety Update 2022 was not on file.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children.

Description: 12 months prior to service and every 24 months thereafter

Noncompliance Area: During the renewal inspection staff #1 did not have a health assessment on file.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Description: Bottles labeled

Noncompliance Area: During the renewal inspection cert rep observed an unlabeled bottle of a child sitting in a car seat with the child.

Correction Required: Disposable nursers and bottles shall be labeled with the child's name.

Regulation: 3270.171(c)

Description: Safe routes posted

Noncompliance Area: During the renewal inspection certification rep observed that a written notification of safe routes was not posted in the facility.

Correction Required: Written notification of safe routes shall be posted by the operator at a conspicuous location in the child care facility.

Description: Individual Records

Noncompliance Area: During the renewal inspection there was one staff person without a file.

Correction Required: An individual record is required for each facility person.

Regulation: 3270.27(f)

Description: Emergency plan

Noncompliance Area: During the renewal inspection certification rep observed that the emergency plan was not sent to the local municipality and to the county emergency management agency.

Correction Required: The operator shall send a copy of the emergency plan and subsequent plan updates to the local municipality and to the county emergency management agency.
