Noncompliance Area: The most recent health assessments on file for Facility Person #1 and #2, who serve as a lifeguards for the program during excursions to Camp Sherwin that include swimming, were each completed more than 24 months prior.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Noncompliance Area: The criminal history clearance on file for Facility Person #3, who serves as a lifeguard for the program during excursions to Camp Sherwin which include swimming, was incomplete as it did not include the results or date disseminated.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). . A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #3 may not work with children as a part of the child care program.

Noncompliance Area: In the infant room, there was exposed foam on a torn child-size sofa.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility.

Description: Health and Safety Training - Pediatric First Aid and CPR

Noncompliance Area: The pediatric first aid & CPR training documented and on file for Facility Person #3 was completed more than 90 days after their start date.

Correction Required: Staff persons shall complete professional development in the topic of pediatric first aid and pediatric cardiopulmonary resuscitation within 90 days of hire.

The current FBI and NSOR clearances on file for Facility Person #5 were completed more than 60 months after the prior respective clearance on file. The criminal history clearance on file for Facility Person #7 was incomplete. The disclosure statement signed and on file for Facility Person #7 was not the most updated form of the disclosure statement at the time of their hire.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #7 may not work in a child care position at the facility without all completed clearances on file.

Description: Assistant Group Supervisor qualifications/Exp, educ., training prior to facility

Noncompliance Area: Facility Persons #1 and #2 were classified as assistant group supervisors. Based on their respective levels of education documented, there was insufficient child care experience documented and on file to meet the requirements to serve as assistant group supervisors.

Correction Required: An assistant group supervisor shall have attained one of the qualification levels specified at § 3270.36(b)(1-5). A facility person's record shall include verification of child care experience, education and training prior to service at the facility.
