Description: Staff assigned to specific children

Noncompliance Area: Staff person #1 was observed sitting on a bench near the towel area focusing on applying sunscreen for approximately 3 minutes. The staff person was not watching the children he was responsible for supervising during this time. Once certification staff intervened and asked the staff person to identify their care group, the staff person took approximately 2 minutes to locate the four children in the care group.

Correction Required: TIERED LIS 1. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises. This portion of the plan shall have an immediate correction date. 2. Facility leadership must develop (or revisit) and implement a written policy regarding the continuous supervision of children at the pool. At minimum, the policy must address the following: -Direct supervision of swimmers, with a focus on being physically present with care groups. -Direct supervision of non-swimmer ·Supervision of children at the towel area when remainder of group is in the pool · Bathroom breaks The policy must include actions taken when facility staff do not adhere to the policy. Facility leadership will submit the policy to DHS for approval. After the policy is approved by DHS, all staff will be trained on the center policy. All staff must sign and agree to adhere to the center policy. Documentation that all staff were trained and signed the policy must be kept on file at the facility. The operator shall provide a date for when this correction will be completed.

Noncompliance Area: The staff present at the pool were unable to identify who was responsible in the director's absence.

Correction Required: A director is responsible for designating a staff person who is responsible for compliance with this chapter in the Director's absence.

Description: Locked or inaccessible/Inaccessible to children

Noncompliance Area: The first aid kit and the sunscreen were observed in a wagon in an area accessible to the children at the pool.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children. A first-aid kit must be inaccessible to children.

Description: Clean, good repair, proper size

Noncompliance Area: On 10/7/24, it was observed that furniture was in need of repair. The cork cabinet in the school age classroom was observed to have a hole in the door on the left side. CORRECTED ON SITE. The shelf in the Kindergarten classroom where the play cash register was located was observed to have peeling wood trim. CORRECTED ON SITE.

Correction Required: Furniture must be durable, safe, easily cleaned and appropriate for the child's size, age and special needs.

Regulation: 3270.124(b)(7)

Description: Name/address/phone release person

Noncompliance Area: On 10/7/24, it was observed that the emergency contact sheet for child 2 did not include an address for one of their release persons.

Correction Required: Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

Description: Pertinent Laws & Regulations/General Health and Safety

Noncompliance Area: On 10/7/24, it was observed that the facility did not have a Continuity of Care plan as part of the facility emergency plan.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children.

Description: 12 months prior to service and every 24 months thereafter

Noncompliance Area: On 10/7/24 it was observed that staff person 2 had a health assessment on file that expired on 6/29/24 that was not updated until 7/29/24.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Description: Comply with CPSL

Noncompliance Area: On 10/7/24, it was observed that staff person 1 had clearances on file which indicated previous criminal history, but no RAP sheets were available. CORRECTED ON SITE.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).

Regulation: 3270.65

Description: Protective Outlet Covers 5 yrs. or less

Noncompliance Area: On 10/7/24, it was observed that outlet covers were missing in the facility. An uncovered outlet was observed in the Preschool 2 classroom on the wall beside the refrigerator. CORRECTED ON SITE. An uncovered outlet was observed on the right side (from the door) wall in Zwingli Hall. CORRECTED ON SITE.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Regulation: 3270.66(d)

Description: Toxic plants not permitted

Noncompliance Area: On 10/7/24, it was observed that a Devil's Ivy plant was present in the Preschool 1 classroom, which is considered toxic.

Correction Required: Toxic plants are not permitted in a child care space.

Regulation: 3270.102(a)

Description: Clean and good repair

Noncompliance Area: On 10/20/23, it was observed that furniture in the facility was in need of repair. The black bookshelves in the reading area of the older school age classroom had peeling/chipped paint. The play kitchen stove in the older school age classroom was chipping across the front. The wooden chairs in the preschool 1 classroom had splintering/chipping wood on the seats and backs.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Description: Building Surfaces/No peeling paint or plaster

Noncompliance Area: On 10/20/23, it was observed that there was the vent covers in the Young School Age and the Preschool 2 classroom had peeling paint.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards. Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Noncompliance Area: On 10/24/22, it was observed that the Lego lap table in the Preschool 1 classroom was broken and had a sharp prong on top of the Lego board.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.
