Correction Required: Play equipment and materials appropriate to the developmental needs, individual interests and ages of the children shall be provided in sufficient amount and variety to preclude long waits for use.

Description: Clean and good repair

Noncompliance Area: It was observed in the classroom that three of the bucket seats for the infant table were not being utilized according to manufacturer instructions as they did not contain safety straps.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Description: 2 feet apart

Noncompliance Area: It was observed that nap cots being used by children were not at least 2 feet apart on three sides.

Correction Required: At least 2 feet of space is required on three sides of a bed, cot, crib or other rest equipment while the equipment is in use.

Regulation: 3270.113(a)

Description: Supervised at all times

Noncompliance Area: It was observed in the classroom, the music and sound machines being used at high volume levels that could potentially prevent staff from being able to properly hear, direct and assess children while sleeping on their nap cots.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Description: Staff assigned to specific children

Noncompliance Area: It was observed that staff person #2 could not identify the specific children to which they were assigned. It was observed in the classroom that children laying on their nap cots were not able to be properly supervised by staff. The nap cots were placed in areas that caused children to be out of sight from staff.

Correction Required: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Description: Restraints prohibited

Noncompliance Area: It was observed that staff person #1 was confining an infant to a small climber while outside in the toddler play space. It was stated by staff person #1 that the child was kept on the climber so that he would not get dirty or eat grass.

Correction Required: A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs.

Description: Emergency plan

Noncompliance Area: The director could not provide proof of an emergency drill having been conducted annually. The last emergency drill on file to have been documented occurred 1/20/26. The director could not provide proof of an emergency drill having been conducted for the year prior to the emergency drill documented to have occurred 1/20/26.

Correction Required: Emergency drills shall be conducted annually. Annual emergency drills shall be documented and on file at the facility.

Description: Locked or inaccessible

Noncompliance Area: It was observed Magic Erasers being stored in an unsecured cabinet under the sink in the kitchen and were accessible to children.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.

Description: Toxic plants not permitted

Noncompliance Area: It was observed in the toddler play space, mushrooms that could be harmful if ingested were growing at the base of the tree and accessible to children.

Correction Required: Toxic plants are not permitted in a child care space.

Description: Building Surfaces

Noncompliance Area: It was observed that the door leading into the kitchen was open giving children access to knives placed on a table and cleaning products stored in an unlocked cabinet under the sink. It was observed in the classroom, a toy shelf that was broken at the base of the back of the shelf that could cause potential injuries to children. It was observed on the toddler outdoor play space, a tree having growth from the trunk that is sharp and pointy and low enough on the tree to cause potential injuries to children. It was observed on the toddler play space an 8 inch opening between the bottom of the fence and the ground causing potential elopement of a child.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Description: Immunization record/ACIP recommended immunization record

Noncompliance Area: Upon inspection of children's files, it was found that Child #1 was missing the following immunizations: MMR, Varicella and Hepatitis A. There was no parental or medical exemption on file.

Correction Required: A health report shall include a review of the child's immunized status according to recommendations of the ACIP. The facility may not accept or retain an infant 2 months of age or older, a toddler or a preschool child at the facility for more than 60 days following the first day of attendance at the facility unless the parent provides written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of the dates (month, day and year) the child was administered immunizations in accordance with the recommendations of the ACIP.

If there are no staff available to supervise staff person #1, staff person #1 may not work in a child-care position at the facility. Description: Small Toys and Objects

Noncompliance Area: Upon inspection of the exterior play space utilized by the infants and young toddlers for plan, at least 12-15 pieces of rubberized mulch from the adjacent playground was accessible to the children in the play space.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.
