Description: Supervised at all times

Noncompliance Area: On 8/21/23 Certification Representative verified fell out of the high chair while being supervise by staff person # 1.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. TIERED LIS: Children must be supervised at all times. The legal entity must arrange for all facility staff to receive a minimum of two hours of training regarding supervision of children. The legal entity must receive DHS approval of the training content prior to scheduling the training. The legal entity must submit documentation in a format approved by DHS proving that the facility procedure for counting children is followed at all times e.g., a checklist. The legal entity will confirm continuing compliance by sending copies of the documentation to the Regional Office of Child Development and Early Learning on a weekly basis for a period of three months after DHS approves the documentation format.

Description: Restraints prohibited

Noncompliance Area: On 8/21/23 Certification Representative verified that staff person # 1 was restraining child in highchair due to biting.

Correction Required: A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs.

Description: No physical punishment

Noncompliance Area: On 8/18/23 during a complaint investigation Certification Representative verified that Teacher #1 did not intervene to stop the child from falling and injuring himself, due to being angry that child was trying to bite her.

Correction Required: Staff person # 1 will no longer be employed at the facility.

Regulation: 3270.113(e)

Description: Restraints prohibited

Noncompliance Area: On the date of the inspection there were 4 children in highchairs in the main room, while the other children in care in that room were either engaged with staff or sitting on the mats watching a video. When asked why those 4 children were in the highchairs staff reported that it was an intervention to redirect unwanted behavior. Upon further interview owner did verbalize that at the end of the day children are sometimes put in highchairs while staff clean up the facility.

Description: Mixed Age Level

Noncompliance Area: At the time of the inspection on the left hand side of the facility: staff person #1 was caring for a total of 7 children including a pair of 2 year old children.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level).

Description: Supervised at all times

Noncompliance Area: At the time of the inspection there were nine children in care and three staff persons providing care. When the staff person opened the door for certification representative, they did leave a one-year-old and two older school aged (a total of three) children in the side room unsupervised. After having returned to the main space from answering the door the staff person did not immediately return to the side room where the children were in care. Moments later an older toddler emerged from the director's office. No person was in the office with him.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Children must be supervised at all times.

Description: Staff assigned to specific children

Noncompliance Area: When asked the names of the specific children in their assigned group the staff person's response was we don't really do it like that here, we all watch them all."

Correction Required: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Correction Required: Emergency contact information is required for each enrolled child. Emergency contact information shall reference who shall be contacted in an emergency.

Description: Comply with CPSL/CPSL information

Noncompliance Area: At the time of the inspection the record of staff person #1 (Having served the facility more than 45 days) did not have the required National Sex Offender clearance letter.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Facility Person # 1 may not work in a child care position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person # 1 may not work in a child care position at the facility.
