Noncompliance Area: On 4/13/26 during a complaint inspection Staff # 1 and # 2 admitted that Child # 1 left the facility. Staff # 2 admitted Child # 1 was gone for at least 20 minutes. Child was found down the street at a grocery store.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises. Tiered LIS: 1. Children must be supervised at all times. This portion of the plan shall have an immediate correction date. 2. The legal entity must arrange for all staff to receive a minimum of three hours of training regarding Supervision. The training must be in-person, and outside of childcare hours. The legal entity must receive DHS approval of the training content prior to scheduling the training. This portion of the plan shall have a correction date of when training is complete. 3. The operator shall demonstrate the ability to maintain compliance with supervision of children during all unannounced inspections conducted by the Department over the next three months. This date will be 3 months from the time the corrections are accepted.

Noncompliance Area: During a complaint inspection on 4/13/26 staff # 3 admitted that the gate in the toddler room was broken on 4/2/26 when Child # 1 left the facility.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: Staff person # 3 has not completed the following required pre-service training within 90 days of their date of hire: Health and Safety Topics including pediatric first aid/CPR from a PQAS approved trainer and a PQAS approved curriculum.

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10, Health and Safety Topics including pediatric first aid/CPR from a PQAS approved trainer and a PQAS approved curriculum. Staff person shall complete professional development in the topics of 3270.31(f) within 90 days of hire. Staff person # 3 will have until 3/6/26 to complete the required training. Until such time as the required training has been completed, staff person # 3 must be supervised, when interacting with children, by a staff person who has completed the required training related to this citation. If there are no staff available to supervise staff person # 3, staff person # 3 may not work in a child-care position at the facility.

Noncompliance Area: Files for Staff # 1 and # 3 were not in compliance with CPSL regulations. File for Staff # 1 contained an expired mandated reporter training dated 1/26/21. File for Staff # 2 contained an expired NSOR dated 2/8/21.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person # 2 may not work in a childcare position at the facility. The CPSL was revised on 9/18/2018 to include a requirement that all clearances be updated and on file at least every 60 months. Tiered LIS: 1. CPSL regulations will be followed at all times. This portion of the plan must be immediate. 2. The legal entity must attend and arrange for anyone responsible for hiring new staff and maintaining files for current staff to register for and attend the existing provider orientation conducted by the NE Regional Office on 2/25/26. This portion of the plan must be completed by 2/25/26.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required pre-service trainings are completed, staff person # 3 must be supervised, when interacting with children, by an AGS who has completed the required training related to this citation. If there are no staff persons available to supervise staff person # 3, staff person # 3 may not work in a childcare position at the facility.

Facility person # 2 hired and working in childcare does not have a state police clearance or child abuse clearance on file for employment. Facility person # 2 has volunteer state police and child abuse clearances on file.

Noncompliance Area: There are 3 stained ceiling tiles in the preschool bathroom and peeling chipped paint behind the toilet. The school aged classroom - Door 7 on the second floor- has storage (car seats, toys, infant swings in boxes, and holiday decorations) in the room measured as childcare space. There is a microwave on a child's chair in the SA classroom Door 6 that is accessible to the children.

Noncompliance Area: During a complaint investigation conducted on 5/15/23, rep observed the original incident report on file at facility with no parent signature for an incident reported on 5/8/23 for child # 1. The original incident report was on file also for an incident reported on 9/21/22 with child # 1. Operator did not have a copy or original incident report of two incidents reported to happen on 3/21/23 and 4/6/23 with child # 1.

Correction Required: A child's record shall contain reports of accidents, injuries and illnesses involving a child in care at the facility. The original report shall be given to the parent on the day of the incident. The second copy of the report shall be retained at the facility in an accident file. The third copy of the report shall be retained at the facility in the child's file.
