Noncompliance Area: During renewal inspection, facility files were reviewed. The facility did not have documentation of completing an annual emergency drill on file.

Correction Required: Emergency drills shall be conducted annually. Annual emergency drills shall be documented and on file at the facility.

Description: Comply with CPSL/CPSL information

Noncompliance Area: During renewal inspection, staff files were reviewed. Staff #1's previous child abuse clearance is dated for 4/23/2020. Staff #1 did not obtain a new child abuse clearance until 4/28/2025. Staff #2's previous child abuse clearance is dated for 4/24/2020. An updated child abuse clearance was not obtained until 4/28/2025. These dates indicate that an updated clearance was not obtained within the 60-month requirement.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. TIERED LIS: 1. The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Description: Services proceeded

Noncompliance Area: During renewal inspection, it was observed that Child #1 did not have an updated child service report on file. Last update on the file was done on 9/19/24. Updates are required to be done every 6 months the child is in care.

Correction Required: The services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in § 3270.124(f) (relating to emergency contact information).

Regulation: 3270.151(a)/3270.192(3)

Description: 12 months prior to service and every 24 months thereafter/Health assessment, TB test

Noncompliance Area: It was observed during renewal inspection that Staff #1 had a previous health assessment dated for 8/10/22. Staff #1 did not obtain a new health assessment until 2/25/25. These dates indicate that an updated health assessment was obtained within the 24-month requirement.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Description: Comply with CPSL/CPSL information

Noncompliance Area: During renewal inspection, it was observed that staff #1 had a previous child abuse clearance dated for 3/27/2019. An updated child abuse clearance was not obtained until 2/13/25. These dates indicate that staff #1 was still caring for children while the clearance was not updated within the 5-year requirement. It was also observed that Staff #1's previous mandated reporter training was dated for 7/30/2019. An updated mandated reporter training was not obtained until 9/15/24. These dates indicate that the updated training was late and not completed within the 5-year requirement.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #--- may not work in a child care position at the facility.

Regulation: 3270.151(a)/3270.151(c)(2)

Description: 12 months prior to service and every 24 months thereafter/Mantoux TB

Noncompliance Area: While at the facility unannounced for the renewal inspection on 4/6/23 the inspector observed that staff #2 was required to have a health assessment prior to hire (Please see Inspection Summary Code Sheet for DOH) and did not obtain a health assessment and a TB screening until 8/10/22.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department.

Description: Comply with CPSL

Noncompliance Area: While at the facility unannounced for the renewal inspection on 4/6/23 the inspector observed that staff #1 had a previous Mandated Reporter training dated 1/4/18 and the most current dated for 2/20/23. Staff #1 Mandated Reporter training was required to be completed on or before 1/3/23.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).

Description: Building Surfaces

Noncompliance Area: While at the facility unannounced on 4/6/23 for the renewal inspection the inspector observed several of the ceiling tiles downstairs had water marks on them

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: While at the facility unannounced on 4/19/22 for the renewal visit the inspector observed that staff #1 (hire date on code sheet) did not have a health assessment on file at the facility as is required.

Description: Age and Training

Noncompliance Area: While at the facility unannounced on 4/19/22 for the renewal visit the inspector observed that staff #1 (hire date on code sheet) did not have proof of the completion of training by a professional in first-aid and CPR as is required.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification.

Description: Above ground window opening restricted to 6"

Noncompliance Area: While at the facility unannounced on 4/19/22 for the renewal visit the inspector observed that the window in the play room on the second floor was not barred from opening 6 inches or fewer.

Correction Required: Windows or doors above the ground floor that open directly to the outdoors and are accessible to children shall be constructed, modified or adapted to limit the opening to 6 or fewer inches.

Description: Building Surfaces

Noncompliance Area: While at the facility unannounced on 4/19/22 for the renewal visit the inspector observed that the ceiling blocks on the first floor had water stains on a majority of the blocks near the rear wall.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Description: Devices must be compliant/Director or designated staff person ensure compliance

Noncompliance Area: While at the facility unannounced on 4/19/22 for the renewal visit the inspector observed that the every 30 days manual fire alarm testing was being conducted every 60 days versus every 30 days as is required.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)).The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.
