Description: Restraints prohibited

Noncompliance Area: On 5/4/26, an unannounced inspection was conducted. Cert Rep observed a small playpen in the infant classroom that staff reported is used to place toddlers in as a form of discipline when the toddlers won't sit in time out. During the investigation it was reported by another child to Cert Rep that the playpen in the classroom is referred to as a "Kid Jail". This small playpen is restricting the toddler's movement and confining toddlers to a small space.

Correction Required: A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs. Tiered LIS: 1. The facility staff will not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. This portion of the plan shall have an immediate correction date. 2. The legal entity must create a discipline policy. This policy must specifically include positives strategies for guiding children's behavior. The discipline policy must include what is appropriate discipline and address what types of discipline are prohibited. The discipline policy must include what to do if a staff person observes another staff person not following the discipline policy. The legal entity must receive approval of the policy from the Regional Office. Once approved by the Regional Office, the legal entity must review policy with all current staff and have staff sign off that they understand and will follow the discipline policy. All new staff hired must review the discipline policy with the director at their time of hire and must sign off that they understand and will follow the discipline policy. The operator shall provide a correction date for when the policy will be reviewed with all staff.

Description: Parent Access & Participation

Noncompliance Area: On 5/4/26, an unannounced inspection was conducted. The operator admitted that at enrollment parents are informed that they are not allowed inside the facility and pick up and drop off is at the door.

Correction Required: A parent of a child in care shall be permitted free access, without prior notice, throughout the center whenever children are in care, unless a court of competent jurisdiction has limited the parental right of access to the child and a copy of the order is on file at the facility. Opportunity shall be provided for parents to participate in the facility's program. The operator shall maintain a yearly file which documents general announcements to promote parent participation. The file shall be updated annually.

Regulation: 3270.31(e)(4)(ii)

Description: Fire safety - 1 yr.

Noncompliance Area: A renewal inspection was conducted on 7/9/25. Staff person #3 did not complete fire safety training annually. This is evidenced by the fire safety training on file dated 1/23/24 and 5/1/25.

Correction Required: Staff persons shall participate, at least annually, in firesafety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Noncompliance Area: A renewal inspection was conducted on 7/9/25. Staff person(s) #1-#3 did not update their NSOR clearance every 60 months as required by the CPSL. This is evidenced by the previously documented NSOR clearance on file being dated 1/16/20 and their current NSOR clearance on file is dated 2/20/25. All other clearances are on file.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A staff person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. The CPSL requires all clearances to be updated every 60 months.

Description: Review policies and procedures

Noncompliance Area: A renewal inspection was conducted on 8/21/24. The parent handbook did not contain a general daily schedule, responsibilities for meals, clothing, and transportation and pick-up arrangements.

Correction Required: The operator shall review with the parent, at the time of application, the facility's general daily schedule, hours for which care is provided, fees, responsibilities for meals, clothing, health policies, supervision policies, night care policies, dismissal policies, transportation and pick-up arrangements.

Description: Each child care space/Written emergency plan posted

Noncompliance Area: A renewal inspection was conducted on 8/21/24. In the gym classroom, the operator acknowledged that emergency contact forms were not present in the childcare space and a written plan identifying the means of transporting a child to emergency care and staffing provisions in the event of an emergency was not displayed.

Correction Required: When children are in the facility, emergency contact information shall be present in a child care space for children receiving care in the space. A written plan identifying the means of transporting a child to emergency care and staffing provisions in the event of an emergency shall be displayed conspicuously in every child care space and shall accompany a staff person who leaves on an excursion with children.

Noncompliance Area: A renewal inspection was conducted on 8/21/24. The facility does not have a policy and procedure to identify the prevention of shaken baby syndrome, abusive head trauma, and child maltreatment.

Correction Required: To maintain compliance with 45 CFR 98.41(a)(1)(vi), in addition to the training requirements, childcare providers must have a policy and procedure to identify the prevention of shaken baby syndrome, abusive head trauma, and child maltreatment. The policy must include but is not limited to: Recognition of potential signs and symptoms of shaken baby syndrome and abusive head trauma; Strategies for coping with a crying, fussing, or distraught child; and address the prevention and identification of child maltreatment.

Noncompliance Area: A renewal inspection was conducted on 8/21/24. In the toddler classroom, staff reported that they wash and reuse infant bottles and they do not use a commercial dishwasher.

Correction Required: Disposable nursers shall be used for infants unless bottles are provided by the parent or unless a commercial dishwasher is used by the facility.

Noncompliance Area: A renewal inspection was conducted on 8/21/24. A written notification of safe routes was not posted by the operator in a conspicuous location in the childcare facility

Correction Required: Written notification of safe routes shall be posted by the operator at a conspicuous location in the child care facility.

Noncompliance Area: A renewal inspection was conducted on 8/21/24. The operator did not provide the parent of each child enrolled with information on how to access the regulations.

Correction Required: The facility's current certificate of compliance shall be posted in a conspicuous location used by parents. The operator shall provide the parent of each child enrolled with information on how to access the regulations in this chapter electronically and with instructions for contacting the appropriate regional child care office.

Description: Emergency plan

Noncompliance Area: A renewal inspection was conducted on 8/21/24. The facility did not conduct an annual emergency drill. The operator acknowledged that an emergency drill was not conducted annually.

Correction Required: Emergency drills shall be conducted annually. Annual emergency drills shall be documented and on file at the facility.

Description: Locked or inaccessible/Small Toys and Objects

Noncompliance Area: A renewal inspection was conducted on 8/21/24. In the toddler classroom, on the diaper changing table was hand sanitizer, plastic gloves, and Clorox wipes. All items were accessible to children.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children. Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Noncompliance Area: A renewal inspection was conducted on 8/21/24. In the gym classroom, the daily activities schedule and the emergency telephone numbers of the nearest hospital, police department, fire department, ambulance and poison control center were not posted.

Correction Required: The telephone number of the nearest hospital, police department, fire department, ambulance and poison control center shall be posted by each telephone in the facility. The written plan of daily activities shall be posted in the group space.
