Description: Clean and good repair

Noncompliance Area: Observed a Step 2 sandbox lid with approximately 6 inch and 2 feet cracks creating rough edges and pinch points in the outdoor play space in front of the house.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Description: Parent receives original/Copy of initial and subsequent agreements. Parent receives original.

Noncompliance Area: The file of Child #2 contained the original agreement. The facility did not make a copy for the file and give the original to the parent.

Correction Required: A parent shall receive the original agreement. The facility shall retain a copy of the agreement. A child's record must contain a copy of the initial agreement and subsequent written agreements between the parent and the operator. The parent receives the original agreement.

Description: Health Information

Noncompliance Area: The file of Child #1 lacked an initial health report no later than 60 days following the first day of attendance at the facility (SEE LIS Code Sheet). The file of Child #1 did not contain a health report.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility.

Description: Pertinent Laws & Regulations/General Health and Safety

Noncompliance Area: Staff person #1 was observed to be caring for children unsupervised. Staff person #1 does not have current pediatric first-aid/CPR training. This is evidenced by the previously documented pediatric first- aid/CPR training expiration date of November 2025.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required pre- service trainings are completed, staff person #1 must be supervised, when interacting with children at a minimum by, a primary staff person who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #1, staff person #1 may not work in a child-care position at the facility.

Regulation: 3280.151(a)

Description: 12 months prior to service and every 24 months thereafter

Noncompliance Area: Staff #1 lacked a health assessment conducted every 24 months. The file of Staff #1 contained a health assessment dated 1/15/24.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Description: Liability Insurance

Noncompliance Area: The legal entity did not have comprehensive general liability insurance to cover all persons who are on the premises.

Correction Required: The legal entity shall have comprehensive general liability insurance to cover all persons who are on the premises. A current copy of the insurance policy shall be on file at the facility.

Regulation: 3280.171(a)

Description: Pick up and drop off points

Noncompliance Area: At the time of the inspection the operator lacked documentation of notifying local traffic safety authorities in writing of the location of the facility and about the program's use of pedestrian and vehicular routes around the group child care facility.

Correction Required: The operator shall notify local traffic safety authorities in writing of the location of the facility and about the program's use of pedestrian and vehicular routes around the group child care facility.

Regulation: 3280.31(e)(4)(i)

Description: Age and training

Noncompliance Area: Staff #1 lacked renewal of their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification. The most current certification observed on file was dated 11/29/23 with an expiration date of 11/25.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and CPR. All staff persons shall renew their certification in pediatric first-aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification.

Description: Comply with CPSL/CPSL information

Noncompliance Area: The file of Household Member #2 lacked a complete State Police Clearance because it did not contain a rapt sheet.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Description: Arts and crafts non-toxic

Noncompliance Area: Observed 4 cans of Equate Shaving Cream which indicated "keep out of the reach of children" on the bookshelf to the right of the entrance door that the operator stated was going to be used for an art activity.

Correction Required: Arts and crafts materials shall be nontoxic.

Regulation: 3280.76

Description: Building Surfaces

Noncompliance Area: Observed rust on the 3rd and 4th panels of the fence to the left of the back gates in the outdoor play space behind the house. Observed rust on the top of the back gates in the outdoor play space behind the house. Observed rust on top of the gate to the right of the house in the outdoor play space behind the house. Observed a cracked gray fence with rough edges attached to the chain link fence to the right of the neighbor's shed in the outdoor play space behind the house.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Regulation: 3280.77(a)

Description: No peeling paint or plaster

Noncompliance Area: Observed peeling paint on the left retaining wall in the outdoor play space in front of the house. Observed peeling paint on the clothes line post in the outdoor play space behind the house.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Regulation: 3280.95(a)/3280.95(b)

Description: FIRE DETECTION/Staff responsibility

Noncompliance Area: The facility was unable to provide written documentation that the fire detection system was manually tested at least every 30 days. The facility provided a written record that the fire detection system was manually tested on 3/28/25, 4/2/25, 5/23/25, 6/20/25, 11/14/25, 12/12/25, 2/6/26, 3/6/26, and 4/3/26. The facility was closed July through October.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)). The primary staff person or designated staff person who is responsible for compliance with this chapter shall ensure the requirements in subsection (a) are met

Noncompliance Area: The files of Children #2 and #4 lacked child service reports completed at least every 6 months. Child #2 who had an admission date of 2/12/24 did not have a child service report. Child #4 who had an admission date of 2/12/24 did not have a child service report.

Correction Required: An agreement shall specify the services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information at § 3280.124(f).
