Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)). The primary staff person or designated staff person who is responsible for compliance with this chapter shall ensure the requirements in subsection (a) are met To verify operability, a child care facility shall manually test all fire detection devices or systems at least once every thirty days and shall maintain a written record of the testing with the facility's fire drill logs.

Correction Required: An agreement shall specify the services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information at § 3280.124(f).

Noncompliance Area: The time between emergency plan training for staff persons #1 and #2 exceeded the permitted annual timeframe (2/13/24, 3/11/25).

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training.

Noncompliance Area: Child #2 and #3's files did not contain the required subsequent health reports after the initial health report (See Code Sheet)

Noncompliance Area: Staff person's #1 and #2's records do not contain current National Sex Offender Registry clearances as evidenced by the expiration date of these previous clearances of 10/7/25. The time between staff person #1 and #2's State Police clearances (10/9/20, 12/4/25), Child Abuse clearances (#1 10/30/20, 12/23/25) (#2 10/30/20, 12/16/25), and FBI clearances (12/6/20, 12/20/25 for #1 and #2) exceeded the permitted 60 months' timeframe. The time between staff person #2's Mandated Reporter Training exceeded the permitted 60 months' timeframe (11/29/20, 1/6/26).

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: Staff Person's # 1 and #2 may not work in a child care position at the facility.

Noncompliance Area: Staff persons #1 and #2 have been supervising children while wading, yet have not completed water safety instruction. (pool was emptied out during inspection)

Noncompliance Area: Cert Rep observed only one staff person for 12 children in care (youngest 3 years) upon arrival at the facility. (corrected during inspection). They were not following staff to child ratio requirements. (corrected during inspection)

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements at §3280.52(b).

Description: Building Surfaces

Noncompliance Area: The outside gate, which prevents children from accessing small rocks, was broken, and not in place. No children under 3 years of age were in care today.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: The children have access to small rocks (less than one inch diameter) in the backyard play area.

Correction Required: Pea gravel and other materials with a diameter of less than 1 inch may not be used in spaces where infants or toddlers receive care.
