Description: Promote development

Noncompliance Area: On 7/1/26, it was verified through staff interview that a staff person is telling children, who are ages 3-4, that they must wait to go to the bathroom even if the bathroom is easily accessible resulting in an increase in accidents for the children.

Correction Required: Daily activities shall promote the development of skills, social competence and self-esteem. Daily experiences shall recognize the child as an individual and give some choice of activities that respect personal privacy, lifestyle and cultural background.

Noncompliance Area: On 7/1/26, it was determined through staff interview that staff in the intermediate A classroom are unable to appropriately manage the classroom and children's behaviors resulting in a lack of activities for all of the children. Staff were observed lifting children and carrying them around to prevent them from acting out, as well as shouting at them.

Tier 1: All facility staff will participate in a training and technical assistance with an outside agency regarding classroom management and appropriate daily activities for children.

Noncompliance Area: On 6/18/26, it was observed that staff person 1 was currently employed at the facility and did not have documentation of a health assessment or TB test on file.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department.

Noncompliance Area: On 6/18/26, it was observed that staff person 3 did not have documentation of two written, nonfamily references on file. Only 1 reference was available. One additional reference is needed.

Correction Required: A facility person's record shall include two written, nonfamily references from individuals attesting to the person's suitability to serve as a facility person.

Description: Comply with CPSL

Noncompliance Area: On 6/18/26, it was observed that CPSL (Child Protective Services Law) was not followed. Staff person 1 had a State Police clearance on file for volunteers. All clearances must be for employment. CORRECTED ON SITE. Staff person 2 had a Child Abuse clearance on file for volunteers. All clearances must be for employment. Staff person 2 may not return to a childcare position until completed clearance is on file.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: Facility Person # 2 may not work in a child care position at the facility.

Description: Adult Hygiene

Noncompliance Area: Staff person #1 did not wash their hands between helping multiple children with toileting. Gloves were used in-lieu of handwashing.

Correction Required: A facility person shall wash his hands before meals and snacks, and after toileting and after diapering a child.

Description: General Health and Safety/Supervised at all times

Noncompliance Area: On 1/29/26, child #1, a young toddler, was buckled into a low chair at the lunch table. Staff person #1 pulled the chair away from the table, unbuckled the child, and stepped away to attend to another child in the room. The child was unable to safely get out of the chair independently and fell forward striking their face and head. As a result of the fall, child #1 sustained both a nasal and a skull fracture.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children. Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Description: Small Toys and Objects

Noncompliance Area: Intermediates B - Small plastic toys with a diameter of less than 1 inch were observed in the sensory table and in the play kitchen area. (CORRECTED ON SITE)

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Description: Staff assigned to specific children

Noncompliance Area: Staff persons #1 and #2 were present with a group of 11 children. When the staff identified their care groups, 1 child was not accounted for.

Correction Required: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Noncompliance Area: The health assessment on file for staff person #5 were dated in October of 2023 and subsequently more than 24 months later in November of 2025. The health assessment on file for staff person #9 were dated in August of 2023 and subsequently more than 24 months later in September of 2025. The health assessment on file for staff person #10 answered "yes" to "Did this individual have any communicable diseases?".

Noncompliance Area: The facility did not have documentation on file that staff person #13 had been trained on the emergency plan during the previous year.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility.
