Noncompliance Area: The health reports on file for child #2 (preschooler) were dated in November of 2024 and subsequently more than 12 months later in December of 2025.

Correction Required: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child.

Description: Written instructions

Noncompliance Area: Albuterol medication was on site for child #1. The medication has been administered per the medication log on site. The medication did not include a prescription label, and the provider was unable to provide documentation of written instructions from the individual who prescribed the medication.

Correction Required: A staff person shall administer a prescription medication only if written instructions are provided from the individual who prescribed the medicine. Instructions for administration contained on a prescription label are acceptable.

Noncompliance Area: Staff person #2 was observed caring for children unsupervised. Staff person #2 has completed Pediatric first aid and CPR training, however the trainer's PQAs approval has expired.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required training has been completed, staff person #2 must be supervised, when interacting with children at a minimum by, an AGS who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #2, staff person #2 may not work in a child-care position at the facility.

Correction Required: An adult health assessment must include an examination for communicable diseases and the results of that examination.

Regulation: 3270.31(e)(4)(i)

Description: Age and Training

Noncompliance Area: Staff person #3's pediatric first aid and CPR training expired at the end of September 2025. Staff person #3 has completed Pediatric first aid and CPR training, however the trainer's PQAs approval has expired. The training was completed in January of 2026, but the trainer's PQAs expired in July of 2025.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification. Until such time as the required training has been completed, staff person #3 must be supervised, when interacting with children at a minimum by, an AGS who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #3, staff person #3 may not work in a child-care position at the facility.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met. To verify operability, a child care center shall manually test all fire detection devices or systems at least once every thirty days and shall maintain a written record of the testing with the facility's fire drill logs.

Description: Child's hands washed/Adult Hygiene

Noncompliance Area: Staff person #1 was observed changing a diaper. After the diaper change, the staff person did not wash her hands, and also did not wash the child's hands.

Correction Required: A staff person shall ensure that a child's hands are washed before meals and snacks, after toileting and after being diapered. A facility person shall wash his hands before meals and snacks, and after toileting and after diapering a child.

Regulation: 3270.135(b)

Description: Surfaces cleaned

Noncompliance Area: Staff person #1 was observed changing a child's diaper. The diaper changing surface was not cleaned after the child's diaper was changed.

Correction Required: Diaper changing surfaces shall be cleaned after each use by wiping the surface with a sanitizing solution or by changing a pad or other surface covering.

Noncompliance Area: The initial health assessment on file for staff person #1 was not dated within the 12 months prior to providing initial service in the child care setting. The health assessment 3 months after start date. The health assessments on file for staff person #7 were dated in April of 2022, and subsequently more than 24 months later in January of 2025.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Description: Fire safety - 1 yr.

Noncompliance Area: Staff person #2's fire safety training was due to be completed in June of 2024, but was not completed until December of 2024.

Correction Required: Staff persons shall participate, at least annually, in firesafety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Description: Health and Safety Training

Noncompliance Area: Staff person #5 did not completed the required pre- service trainings (f-1-9) within 90 days of their date of hire. The trainings were completed 144 days after the date of hire.

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-9. (1) Prevention and control of infectious diseases (including immunization) and the establishment of a grace period that allows homeless children and children in foster care to receive services under this subchapter while their families (including foster families) are taking necessary action to comply with immunization and other health and safety requirements. (2) Prevention of Sudden Infant Death Syndrome and use of safe sleep practices. (3) Administration of medication, consistent with standards for parental consent. (4) Prevention of and response to emergencies due to food and allergic reactions. (5) Building and physical premises safety, including identification of and protection from hazards that can cause bodily injury such as electrical hazards, bodies of water and vehicular traffic. (6) Prevention of shaken baby syndrome and abusive head trauma. (7) Emergency preparedness and response planning for emergencies resulting from a natural disaster or a man-caused event (such as violence at a child care facility) within the meaning of those terms under section 602(a)(1) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C.A. § 5195a(a)(1)). (8) Handling and storage of hazardous materials and appropriate disposal of biocontaminants.
