Description: Surfaces cleaned

Noncompliance Area: During the renewal inspection on 12/11/2025, it was observed that staff #1 did not clean the changing table in between diaper changes after changing child #1.

Correction Required: Diaper changing surfaces shall be cleaned after each use by wiping the surface with a sanitizing solution or by changing a pad or other surface covering.

Noncompliance Area: During the renewal inspection on 12/11/2025, the file for staff #2 was viewed and had a National Sex Offender Registry Clearance that was dated 11/6/20 which is more than 60 months old. (See code sheet for hire date)

Correction Required: Staff #2 must be removed from a childcare position by the close of business because she/he does not have all the required clearances or requests for clearances. All required clearances must be obtained before staff #1 may resume a childcare position.

Description: Clean and good repair

Noncompliance Area: During the renewal inspection on 12/5/2024, it was observed that the cubby was not secure to the wall and was a tipping hazard.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: During the renewal inspection on 12/5/2024, it was observed that the emergency plan did not include a Continuity of Care policy.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children.

Description: 12 months prior to service and every 24 months thereafter/Health assessment, TB test

Noncompliance Area: During the renewal inspection on 12/5/2024, the file for staff #1 was viewed and last health assessment completed was dated 6/8/22, it was not conducted within the past 24 months.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Description: Emergency plan

Noncompliance Area: During the renewal inspection on 12/5/2024, it was observed that the emergency plan did not include a lockdown policy.

Correction Required: The facility shall have an emergency plan that provides for shelter of children during an emergency including lock-down, shelter in place at the facility and shelter at locations away from the facility premises.

Regulation: 3280.31(e)(4)(i)

Description: Age and training

Noncompliance Area: During a renewal inspection on 12/5/2024, the file for staff #2 was viewed and the most recent Pediatric CPR/First Aid certification expired on 12/31/23.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and CPR. All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification.

Description: Protective Outlet Covers 5 yrs. or less

Noncompliance Area: During the renewal inspection on 12/5/2024, it was observed that the electrical outlet behind the desk did not have a protective cover in it and it was accessible to the children.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Description: Clean, good repair, proper size

Noncompliance Area: During the renewal inspection dated 12/14/2023, certification representative observed that the shelf was a tipping hazard for the children, and was unsafe. Also, a shelf near the front of the facility had broken and chipping particle board on top that was unsafe for the children.

Correction Required: Furniture must be durable, safe, easily cleaned and appropriate for the child's size, age and special needs.

Regulation: 3280.113(e)

Description: Restraints prohibited

Noncompliance Area: During the renewal inspection dated 12/14/2023, certification representative observed that child #1 was restrained in a high chair for over 30 minutes while the other children were sitting at the table.

Correction Required: A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs.

Description: Insurance coverage information

Noncompliance Area: During the renewal inspection dated 12/14/2023, certification representative observed that Child #1, and child #2 (see code sheet for admission date) did not have health insurance policy numbers on their emergency contact forms.

Correction Required: Emergency contact information must include health insurance coverage and policy number for a child under a family policy or Medical Assistance benefits, if applicable.

Description: Health Information/Initial and subsequent health assessments

Noncompliance Area: During the renewal inspection dated 12/14/2023, certification representative reviewed the file for child #2 (see code sheet for admission date), and there was not any initial or subsequent Child Health Assessments in the file and child #2 has been enrolled for more than 60 Days at the facility.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility. A child's record must contain initial and subsequent health reports.

Description: Ongoing compliance

Noncompliance Area: During the renewal inspection dated 12/14/2023, certification representative observed that the Certificate of Occupancy was not onsite for certification representative to view as required by the regulations.

Correction Required: (b) The legal entity shall maintain ongoing compliance with the applicable requirements prescribed by the Department of Labor and Industry in 34 Pa. Code § 403.23 and under section 1016(c) of the act at all times following issuance of any certificate of compliance granted by the Department under this chapter.

Noncompliance Area: During the renewal inspection dated 12/14/2023, certification representative reviewed staff person #1 File and staff person #2 (see code sheet for hire date). Staff person #1 has not completed the following pre-service trainings within 90 days of hire: Pediatric CPR/First Aid training, the Mandated Reporter training, and the Health and Safety Training, and staff person #2 has not completed Pediatric CPR/First Aid training as required per the 3280 regulations.

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10. The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Staff person #1 and staff person #2 will have until 12/29/2023 to complete the Mandated Reporter Training, Pediatric CPR/First Aid training, and the Health and Safety Training, Until such time as the required training has been completed, Staff person #1 and staff person #2 must be supervised when interacting with children, by a primary staff person who has completed the required training related to this citation. If there are no staff person(s) available to supervise staff person #1 and staff person #2 they may not work in a childcare position at the facility.
